TECMEDIA INTERNET DESIGN LTDA. (Tecmedia), registered under CNPJ nº 01.657.689/0001-94, with headquarters at Rua José Venâncio, nº 2489, Bairro São João, CEP: 88702-711 – Tubarão/SC, sole and exclusive owner of the Tecmedia Corporate Portal system, hereinafter referred to as Tecmedia Site, establishes this TERMS OF USE for USERS in accordance with the conditions set forth below. Any use of this tool constitutes the user's consent to the following terms and conditions:

1. TECMEDIA may, at any time and at its sole discretion, modify the configuration of the Tecmedia Site, always with a view to improving it.
2. All content, appearance, organization and structure of the Tecmedia Site are protected by applicable intellectual property legislation and do not infringe any law or standard to which they are subject, contracts, documents, agreements of which they are part, as well as do not infringe third party rights. The violation of such rights will result in the respective compensation to those harmed, whether TECMEDIA, its USERS and/or third parties, without prejudice to losses and damages and attorney fees.
3. The USER is solely responsible for any content that is transferred via upload, posted or otherwise transmitted through the Tecmedia Site. TECMEDIA is not responsible for the improper publication of third-party intellectual property posted.
4. The USER is prohibited from:
   • Modifying, copying, distributing, disclosing, transmitting, displaying, performing, reproducing, publishing, making available, licensing, renting, selling, reselling or creating derivative works from the information, applications and services of the Tecmedia Site as well as transferring or selling such information from any content on this portal, whether in whole or in part, except when authorized by TECMEDIA, under penalty of violation of these terms and legal infringement;
   • Using in any way excerpts, reverse engineering techniques in the development or creation of other works in order to analyze their constitution;
   • Granting access to third parties in an unlawful manner.
5. Any errors in the operation of the Tecmedia Site will be corrected during the period stipulated by TECMEDIA for maintenance. TECMEDIA is not responsible for damages resulting from misuse of the Tecmedia Site.
6. Any notices or communications that one party must make to the other party, regarding any rights or obligations contained in this instrument, must be in writing and will be deemed effectively delivered at the address set forth in the preamble of these TERMS, if: (a) delivered in person by written protocol by someone authorized to represent the sending party; (b) sent by "courier" service by written protocol or by mail, in the form of registered letter ("AR"); or (c) sent by e-mail, or other electronic means capable of such communications. The parties agree that the receipt of messages and electronic files constitutes documentary proof for all purposes, provided that there is a confirmation of receipt notice or other type of protocol that certifies receipt of the communication.
7. Through its Privacy Policy, TECMEDIA undertakes to make its best efforts to maintain the confidentiality of all personal data of the USER who has registered in the system.
8. The USER must complete the registration form providing true and accurate data and information, being civilly and criminally responsible for its veracity, and must update the data and information whenever there are changes.
9. The USER is aware that he has read and agrees with the terms and conditions of this instrument.
10. The USER acknowledges and agrees that all services and content, as well as any application available here, have use restricted to the purposes proposed on this portal and are subject, including, to the following laws:
    • Software Law (Law no. 9,609, of 02/19/98), which provides for the protection of intellectual property of computer programs;
    • Copyright Protection Law (Law no. 9,610, of 02/19/98), which amends, updates and consolidates legislation on copyright and provides for other measures.
11. The hosting infrastructure services used on the Tecmedia Site are outsourced to trusted companies. In case of failures in this type of service, TECMEDIA undertakes to intervene with the third party, in order to jointly seek a solution to the problem.
12. Technical support will be offered by TECMEDIA according to user demand and the type of plan contracted. Free services, regardless of the period of use, are not subject to support guarantee.
13. The proper functioning of the system is directly linked to its correct use by users as well as the quality of the information posted on it. Therefore, TECMEDIA will not be responsible for the results obtained with the use of the tool, except through a contract for the provision of consulting services or evolutionary maintenance.
14. The parties elect the court of the District of Tubarão, State of Santa Catarina, as competent to resolve any disputes arising from these TERMS OF USE, regardless of any other, no matter how privileged it may be or become.
